Some say that since you are pushing on the flipper portion of the blade and not a "switch" or "button" that they are not switchblades. I have never had an adequate answer as to whether or not these are considered switchblades or not. I have several Kershaw assisted opening knives and the Camillus Dominator also assisted opening. So just when you think you are complying with the law, you may very well be wrong! Unless there is a legal precedent, you really have to be careful. I agree that many statutes are so full of legal mumbo jumbo that even lawyers and judges will interpret them completely differently. The latter is considered contraband and would be a felony to carry. A spring deployed blade, by use of a switch is legal so long as the blade does not detach and shoot out. The definition of auto in Florida is specific. Ordering from out of state is possible from many web sites, but unless you are military or law enforcement you and they are violating Federal law. If you can find a distributor in your state, and your state has defined auto's as legal, then you should be perfectly safe to buy and carry. Microtech is located in Florida, so purchase is perfectly legal as it does not cross any state lines. But my own research leads me to think that the Florida legislature has deemed the switchblade to be in the same category as a common pocketknife. I have had several knowledgeable people advise me that it would be wise to have a CCW permit when carrying since it seems to fall outside the "common pocketknife" category. In Florida, a switchblade is legal to own and carry. Which is what they are trolling for in the first place. but they are always willing to sell for a higher price discreetly under the table. I see this scam at a lot of gun shows around the country. And at the very least, would most likely lose their job over it. (Which he or she may be), Would be wide open for a civil liability suit. Should an officer have to use a knife that is a Federally prohibited weapon. I defense, offense, Suspect restraint, or in any other manner. I have yet to see a training program on deploying a switch blade (Or known by its more politically correct name. More importantly, leo have to be trained and certified, or checked out on any and all weapons carried in a official capacity. Leo in not mentioned in the law as an exception. Federal law prohibits most from carrying autos. As a maker, I have had to help a few out with the laws regarding Autos from time to time. LEO although many carry them, have no special right to do so.
